General Terms & Conditions

1. Introduction

This website, accessible at www.dobiz.co.za, including all associated mobile applications, software, content, and services (collectively the "Website" or "Platform"), is owned and operated by Passive Web (Pty) Ltd, registration number 2024/613989/07, trading as DoBiz ("DoBiz", "we", "us", or "our").

By accessing, browsing, registering on, or using the Website in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, you must immediately stop using the Website.

These Terms apply to all users of the Website, including visitors, registered users, businesses, affiliates, advertisers, customers, and any other person accessing or using the Platform ("user", "you", or "your").

By creating an account, clicking acceptance buttons, submitting forms, making payments, or continuing to use the Website, you are deemed to have electronically agreed to these Terms in accordance with the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act").

2. Important Notice: Consumer Protection Act

These Terms contain provisions that may:

  • Limit the risk or liability of DoBiz;
  • Create risk or liability for you;
  • Require you to indemnify DoBiz; and/or
  • Serve as acknowledgements by you of certain facts.

These provisions should be carefully read and understood.

Nothing in these Terms is intended to unlawfully limit or exclude any rights afforded to consumers under the Consumer Protection Act 68 of 2008 ("CPA") or any other applicable South African law.

3. Eligibility and Account Registration

Certain features of the Website may only be available to registered users.

To create an account, you may be required to provide accurate and complete information including your name, email address, password, and any other information reasonably required by DoBiz.

By registering an account, you agree that:

  1. You will provide accurate and truthful information.
  2. You are responsible for maintaining the confidentiality of your login credentials.
  3. You are responsible for all activity occurring under your account.
  4. You will immediately notify DoBiz of any unauthorised use of your account or security breach.
  5. You will not share or transfer your account to another person.
  6. You are at least 18 years old or are using the Website under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

DoBiz reserves the right to refuse registration, suspend accounts, remove accounts, or restrict access where it reasonably believes that these Terms have been breached, unlawful conduct has occurred, fraudulent or abusive activity exists, or continued access may create risk or harm to the Platform, users, or third parties.

4. Acceptable Use

You agree to use the Website only for lawful purposes and in accordance with these Terms. You may not upload unlawful or misleading content, use automated systems without permission, impersonate another person, or engage in conduct that may expose DoBiz or other users to legal liability. DoBiz reserves the right to remove content, restrict access, or suspend accounts as necessary.

5. Payments, Memberships and Refunds

Payments on DoBiz are processed through third-party payment providers including PayFast. DoBiz does not collect, store, or process payment card information directly. All prices are shown in South African Rand on the Platform at the time of purchase, and the amount you pay is the amount calculated by DoBiz at checkout.

Paid memberships are recurring subscriptions. Monthly memberships are billed every month and yearly memberships are billed every year, on the same date as your first payment, until you cancel. You may cancel at any time from your account page; cancellation stops all future payments and ends the membership benefits immediately. Changing to a different membership is done by purchasing the new membership, after which the previous subscription is cancelled automatically.

Except where otherwise required by applicable law, payments made for digital products, advertising, memberships, promotional services, listings, subscriptions, or services already rendered are non-refundable.

6. Intellectual Property

All content, software, text, graphics, logos, designs, trademarks, images, audio, video, databases, and materials displayed on the Website are owned by DoBiz or its licensors and are protected by applicable intellectual property laws. You may not reproduce, copy, distribute, modify, or commercially exploit Website Content without DoBiz's prior written consent.

Termination does not entitle users to refunds except where required by law.

20. Changes to These Terms

2. Nature of the Program

The Program is a referral incentive program. It does not create any employment relationship, partnership, joint venture, agency, or franchise relationship between you and DoBiz.
